Digital Millennium Copyright Act compliance and takedown procedures
The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright owners to request the removal of infringing content from online platforms. Swaply respects intellectual property rights and complies with the DMCA by promptly addressing valid takedown notices. This applies to all content uploaded to Swaply including item photos, descriptions, profile images, and any other user-generated content.

A valid DMCA takedown notice must contain: 1. Identification of the copyrighted work you claim has been infringed 2. Identification of the material on Swaply that you claim is infringing, with enough detail for us to locate it (URL) 3. Your contact information (name, address, phone number, email) 4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner 5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner 6. Your physical or electronic signature
If you believe your content was removed by mistake or misidentification, you may file a counter-notice. Your counter-notice must include: identification of the removed material and its location before removal, a statement under penalty of perjury that you believe the material was removed by mistake, your name, address, phone number, and consent to jurisdiction. Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, the content may be restored.
Swaply will terminate the accounts of users who are repeat copyright infringers. If a user receives three valid DMCA takedown notices, their account will be permanently suspended. We track all DMCA notices and maintain records for compliance purposes.
